Representative Cases: CII Carbon, LLC v. Entergy Louisiana, Inc. LPSC Docket No. U-23968 Complaint proceeding on behalf of small cogenerator against incumbent electric utility for underpayment of avoided costs to the client, as mandated by PURPA. Confidential settlement with refunds to cogenerator client entered after Administrative Law Judge rendered final recommendation in favor of cogenerator. The final recommendation represents the only successful challenge to a utility's avoided cost methodology and payments by a cogenerator before the LPSC.

Description of Practice: Mr. Piontek possesses extensive experience representing regulated public utilities and other regulated entities before the Louisiana Public Service Commission (“LPSC”) in rate cases, cost-of-service investigations, prudence investigations, complaint proceedings, rule-making proceedings, and various other regulatory proceedings affecting natural gas, transportation, and pilotage services. He also represents commercial, industrial, and residential ratepayers, as well as developers of cogeneration projects, in matters involving electricity and water and sewerage service before the LPSC, other regulatory bodies, and in state and federal courts. Mr. Piontek’s commercial law experience extends to contract and transactional issues, and litigation of antitrust claims and unfair trade practices claims. He also represents both plaintiffs and defendants in a variety of class action cases involving issues such as antitrust and breach of contract.
